Dog owner fined for failing to control his barking pet

A man who allowed his dog to continue barking has been successfully prosecuted, following an investigation by Enfield Council’s environmental health team.

Mr Yasar Mustafa, 39, from Enfield (EN3), was investigated by the Council after receiving complaints from his neighbours, about loud barking from his German Shepherd dog.

The Council received several complaints about the noise nuisance from his neighbours dating back to September 2024.

Mustafa was served a statutory noise abatement notice on 13 February 2025, as he was in contravention of the Environmental Protection Act 1990.

On 1 July 2026, Mustafa attended for a trial at Highbury Corner Magistrates Court in north London, where he was found guilty of breaching the notice served upon him.

Mustafa attended court again on 6 August 2026, where a judge ordered him to pay a fine of £250, the Council’s costs of £1,500 and a victim surcharge of £100. Total: £1,850.

Cllr Elisa Morreale, Cabinet Member for Licensing at Enfield Council, said: “Loud noise such as dogs barking continually is antisocial behaviour, and negatively impacts our residents’ lives.

“The action taken by our environmental health officers in response to complaints and disturbances in this case, demonstrates our commitment to prosecute those who do not comply with the authorities.”

Mustafa was allowed to keep his dog and continues to live at his private residence in EN3.

The case involving Mustafa is a prime example of how continuous loud noise like dogs barking affects resident’s ability to enjoy their homes, with their families and visitors.

A legal notice served after investigation was not complied with, so the Council took the strongest possible action by taking the owner to court. A judge agreed with the Council’s findings and the severity of the case was reflected in his sentencing.
