Overhang Licence

Processing of licences to enable features to overhang the highway.

Awnings
Box Signs, CCTV Equipment etc.To allow for the safe passage of pedestrians beneath projections from frontage development, such as awnings, canopies, box signs and CCTV equipment, a minimum vertical clearance of 2.75 metres is required from the surface of the footway to the underside of any projection. Whilst a highway licence may not be required for retractable awnings and box signs, advertisement consent may still be needed.

Buildings
In addition to the need for planning permission for new development, a highway licence will also be required if any part of a building projects over the highway. Early discussions should therefore be held with the Council to establish the feasibility of any overhang. The cost of preparing a licence will need to be met by the applicant. In cases where the Council owns the sub-soil beneath the highway a charge may also be made for the use of the air space.

Beams, Pipes, Cables etc.
A highway licence is required for beams, rail, pipe, cable, wire or similar apparatus to be placed over, along or across the highway. The cost of preparing the licence will need to be met by the applicant and the Council will need to be fully indemnified against any loss or injury. Service description.

Relevant technical drawing showing the design and of the overhang/projection, it location in relation to the kerb line and highway surface, method of attachment, method statement for erecting and maintaining the feature.

Service Level Agreement and Turnaround
The Council will aim to process all licence applications within 8 weeks of receipt of all necessary information.
