Notice of changes that may affect your building works - Permitted Development
In September 2008, the Government announced changes to existing planning regulations that govern what can be built without the need to obtain formal planning permission from the Council. This is referred to as permitted development.
These changes come into effect on 1st October 2008.
As a result, after this date, extensions to residential properties including surfacing of front garden areas and building detached structures in rear gardens, may not continue to be permitted development.
What does this mean for me?
If you made an application to the Council and received notice that the works were Permitted Development but have not started the building works by 1st October 2008, you will need to check that the works are still lawful.
If you start work after 1st October 2008, you may find that the development is not lawful.
If you have started but not finished the works by 1st October 2008, these changes will not affect the lawfulness of the works.
How do I check if my application is still lawful?
Advice is available from the Planning Portal on: http://www.planningportal.gov.uk/england/genpub/en/1115311947777.html
The full Statutory Instrument published by the Government can be seen on: http://www.planningportal.gov.uk/uploads/hhg/houseguide.html
What do I do next?
If you have checked the Planning Portal website and think that your building works are no longer Permitted Development, you should contact the planning team on 020 8379 1000.
Alternatively, you may wish to seek confirmation by applying for a further Certificate of Lawful Development. Forms, guidance notes and the Lists of Planning Application Requirements may be found at http://www.enfield.gov.uk/608/Application%20Forms.htm
