Land and property - demolitions - control and advice

Owners wishing to demolish a building must give notice to the local authority under section 80 of The Building Act 1984 and if all is satisfactory Building Control will issue a notice with a schedule of requirements including termination of services, clearing and making the site safe.

On receipt of a written notice of intention to demolish, building control will notify relevant services of the intention.
We will then issue a list of requirements (counternotice) to the owner/demolition contractor in regard to utilities, drains, shoring, clearance and making safe.
Subsequently site visits are made to ensure compliance with the notice.
Demolition must not commence until either the counternotice is issued, or 6 weeks after deposit of the notice of intention to demolish.
Demolition notification is NOT required for: -

A building being demolished because of an order made under the Housing Act 1985, or
An internal part of an occupied building, or
A small building less than 1765 cubic feet in volume or an attached outbuilding such as a garage, or
An agricultural building.

The above notice is in addition to any approvals required under planning or other legislation.
