Refuse - flytipping

The council has responsibility for acting on reports of flytipping to both remove the waste and to locate and prosecute the offenders. Where the waste is hazardous the council has a responsibility to ensure public safety until such time as the waste can be removed. The Environmental Crime Unit is responsible for the enforcement of those responsible for flytipping.

The Environmental Crime Unit will investigate all witnessed incidents of fly tipping or those fly tips which contain evidence of who is responsible for the fly tip or where the waste originated from. All other fly tipping incidents should be reported to Cleansing and Waste Services, who will arrange to remove the waste.

Fly tipping is a criminal offence and those responsible for carrying out this act face serious criminal charges. Fly tipping is an arrestable offence, which carries a maximum penalty of £50,000 in the Magistrates Court or a Five Year prison sentence, at the Crown Court.

Service Level Agreement and Turnaround
The initial investigation will be completed within 10 days after which time the complainant will be advised whether or not further action will be taken or the incident closed.

The Council have a 4-hour target to remove all flytips from the highway.
