Roads - pavements - personal injury | |
Insurance claims, property damage, personal damage, vehicle damageDealing with reports of personal injury caused by damage and/or hazards on roads and pavements, which it is the responsibility of the local authority to maintain. Any hazard in the highway (road or pavement) caused as a result of an accident, damage or vandalism may be considered a risk to the public and could result in personal injury to pedestrians, road users or possible damage to property.
For emergency work, Highway Services aims to make a hazard safe within two hours. The damage is assessed by an Inspector and an order issued for repairs as reactive work within 10 working days. In the event of reporting an accident, it is likely that the Highway Services would inspect it as an emergency. When a report of a hazard or damage is received, the staff member taking the report will attempt to identify ownership and establish who is responsible for the property or street furniture from the details provided. If the damage is clearly not the responsibility of the Council, ownership details can be established and Highway Services will contact the respective statutory undertaker or owner responsible. A request is made to attend and make the hazard safe within a set timescale. If unable to meet this timescale, the Council will make the hazard safe and will then recover the costs. If a personal injury occurs, you will be advised to write to the London Borough of Enfield, Insurance Section, PO Box 54, Enfield, Middlesex, EN1 3XA stating the nature of the potential claim including time, manner, and location of incident. You will also be advised to submit any supporting material such as photographs or reports etc. The Insurance Team will then liaise with the appropriate section to gain a full report. Upon recepit of the report, your claim will be assessed. It is important that we are provided with the precise location i.e) street name, house number or landmark. Without these details, your claim could be delayed. It would also help us if you were able to supply a photo of the alleged defect that caused you to make this claim. If you have already made a claim and are awaiting an update, write in to the London, Borough of Enfield, Highway Services, 7 Melling Drive, Enfield, Middlesex, EN1 4BS and marking the envelope ‘exisiting claim’ or telephone the office on 020 8379 2323.
