The LEA may provide free home to school transport for a child with special educational needs. Eligibility is based on assessment of individual need in accordance with the Authority's Home to School Transport Policy. The Authority is required under section 509(1) of the 1996 Education Act to make provision of transport, or otherwise, as they consider necessary, for the purpose of facilitating the attendance of persons receiving education and transport provided under this section must be provided free. Local Authorities are generally only under a duty to provide free transport to a child’s nearest suitable school, provided it is beyond statutory walking distances. Decisions about eligibility are made by the SEN Service in accordance with Enfield’s Home to School Transport policy. Any exceptional requests are considered by the Authority’s SEN Panel. The policy sets out in details the criteria used when deciding if a particular pupil should be provided with transport. This includes The age of the pupil.
Pupils with Statements of SEN and pupils attending special schools or units are not automatically entitled to assistance with travel. Decisions about how transport assistance will be made will be taken by the Transport Operations Service. (Tops). Tops will liaise with the SEN Service in respect of exceptional cases. Eligibility
