Former Tenant ArrearsWhen a person leaves a Council tenancy they become known as a 'former or late tenant'. If there are arrears at the end of the tenancy the Council will continue to pursue these. The council will discuss repayment terms with the tenant and could, if payment is not made, summons the former tenant to Court to get an Order for payment. It is essential that the Council collects all debts owed in order to maximise its income and achieve its objectives of delivering an efficient and cost effective Housing Management service. A former account occurs when a tenancy is terminated. Former accounts may hold a credit or debt. Where there is a credit the Council will ensure that there are no other debts owed by the account holder, before giving a refund. In some cases accounts are terminated with arrears. The Councils policy for the collection of former tenant arrears is based on a firm, fair and supportive approach, in line with best practice, the Council’s Debt Charter and common law. The Council operates a Former Tenant Arrears team, which is solely responsible for dealing with the former accounts of secure Local Authority tenants and Tolerated Trespassers, collecting any debts that they might owe.
